What Are Conveyancing Fees in South Africa?
Conveyancing fees are the attorney fees charged for transferring ownership of fixed property in South Africa. The process involves a transferring attorney (appointed by the seller), a bond attorney (appointed by the bank if a bond is registered), and a bond cancellation attorney (if the seller has an existing bond to cancel). Each charges separately.
What Determines the Fee Amount?
The Law Society of South Africa publishes a recommended tariff based on the property value or bond amount. While not legally binding (attorneys can charge more or less), most conveyancers charge at or near tariff. The tariff is a sliding scale β higher property values have higher fees, but the percentage decreases at higher values.
Who Pays What?
The purchaser pays the transfer attorney fee, bond registration fee, and transfer duty. The seller pays the bond cancellation attorney fee (from sale proceeds). The deeds office levy is typically split or included in the transfer fee.
